Jasper sits in Pickens County, not Cherokee

Jasper is the county seat of Pickens County, the next county north of Ball Ground. The City of Nelson describes Jasper as seven miles north of Nelson, and Nelson as about three miles north of Ball Ground, so most Jasper jobs are a short drive up the Georgia 515 corridor from the north end of I-575. That matters because Cherokee County's tree ordinance, Article 27, stops at the county line. Jasper properties answer either to the City of Jasper or to Pickens County, depending on whether the parcel is inside the city limits.

A 30143 mailing address covers both city and county land. Your tax bill or the county parcel record shows which government applies. If the record says City of Jasper, the city's ordinances apply on top of state law. If not, Pickens County's ordinances do.

Inside the City of Jasper

Jasper's code of ordinances does not ask a homeowner to get a permit simply to cut down a tree in a yard, as far as we could find in the published code. It does regulate land disturbance. Section 26-117 says no person may conduct land-disturbing activity within the city without first obtaining a permit from the building and zoning department, and the application must include an erosion, sedimentation and pollution control plan. Clearing a lot for a house, a driveway or an addition can cross that line even when the trees themselves are not protected.

The city's Planning and Development office at City Hall, 200 Burnt Mountain Road, handles zoning questions and lists 706-692-9100 for planning. If a contractor proposes grubbing stumps, regrading or clearing more than a few trees, ask the city first and keep the answer in writing.

Jasper's code also includes an allowable street tree species list in Section 94-314. It names native overstory trees such as red maple, white oak, willow oak and northern red oak, and native understory trees such as eastern redbud and hop hornbeam. If you are replacing a tree near the street, that list is a good place to start.

Unincorporated Pickens County around Jasper

Outside the city, Pickens County Planning & Development at 1266 East Church Street in Jasper issues building permits and land disturbance permits. The county's residential building guidelines say that if building plans disturb more than one acre, a land disturbance permit must be filed before any work begins, citing county code Section 38-692. The county's erosion and sediment control page explains that a design professional prepares the plans, the county stamps them, and the Georgia Soil and Water Conservation Commission must approve them before the county issues the permit.

Ordinary removal of a hazardous tree from an existing homesite does not usually involve that process. Clearing land for a new house, barn or pasture often does, so ask before the equipment arrives. For planning a larger job, our land clearing guide explains how the state erosion rules work in practice, even though its county details are for Cherokee.

Burning brush in Jasper

Pickens County is one of the 54 counties in Georgia EPD's summer open burning ban, listed under EPD's Mountain District. From May 1 to September 30 you may not burn yard or land-clearing debris. Plan to have brush chipped or hauled during those months.

Outside the ban, the Georgia Forestry Commission requires a burn permit for several burn types, including land-clearing and storm-debris burns. One detail differs from Cherokee County: EPD lists Cherokee among the 19 metro non-attainment counties where the forestry prescribed-burning exemption does not apply, and Pickens is not on that list. That exemption is for forestry burns, not yard piles. For general burn guidance, see burning tree debris.

Mountain lots, slopes and storms

Many Jasper-area parcels are wooded and sloped, with long gravel drives. Ask a provider how they will reach the tree, whether a crane or bucket truck can get in, and how they will protect the driveway and septic field. Trees that come down in storms often land on lines or roofs. Georgia Power says no one should climb trees near power lines and asks customers to report trees touching lines. Our storm damage guide covers what to photograph for insurance.

Georgia's Utility Facility Protection Act treats mechanized stump removal as excavation, so a Georgia 811 locate request comes before stump grinding. A provider should make that request or confirm you have. See stump grinding for what to ask.

Hiring for a Jasper job

Tell the provider whether the property is inside the City of Jasper or in the county, how close the tree is to the house and lines, and whether you want the wood left, split or hauled. Ask for a written scope that lists every tree, the cleanup, stump work, and who handles any permit. For dead pines, our pine beetle guide explains why removal timing matters. For hazard trees, see dead and hazard tree removal.
